17. Dispute Resolution/Arbitration Provisions.

By using the fairytales Service, you agree to the following arbitration provisions:

  1. all disputes arising in connection with the Service (whether based on contract, tort, or otherwise) shall be resolved by binding arbitration administered by JAMS.
  2. the arbitration shall be conducted under the Federal Arbitration Act (FAA) and shall be decided by an independent arbitrator. 3. the place of arbitration shall be the State of California.

  4. the arbitrator shall apply the laws of the State of Florida and respect the legitimate privilege of confidentiality.
  5. the arbitration shall not be conducted as a class action or representative action.
  6. the arbitrator shall have no authority to award punitive damages.
  7. in the event that the cost of arbitration is excessive, the Company will assist in paying the costs.
  8. in the event that clause (6) of the arbitration clause is invalid, the entire arbitration clause shall be null and void.
